Swedish defence fined for unauthorized media procurementThursday, 09 February 2012
A Swedish armed force has been fined to pay the sum of Skr270 000 after carrying out an unauthorized media procurement. It came after the Swedish competition authority brought the matter to the competition Administrative Court. In its judgement, the Swedish armed force was found to have failed and was thus fined.
“The Administrative Court has ruled that the Armed Forces have acted contrary to the law of public procurement when it purchased advertisement services from the firm Carat. We find it gratifying that it had been established as clearly as can be done in this judgment from the Administrative Court,” says Dan Sjöblom, Director General of the Competition Authority.
The Armed Forces will therefore pay Skr270 000 in fines because they made an illegal indirect contract with the media agency Carat instead of opening their project for general bidding.
This judgment is the first from an administrative court after the Competition Authority on its own initiative, requested that an agency should have paid the procurement fee.
Several cases of miscarriage of procurement are now in queue waiting to be heard in the court and one can expect that insider dealers that undercut the competition rules will pay a hefty prices .
“We have so far submitted 20 applications to court, we are on the investigative stage of a number of other cases and will surely bring a number of them to court,” says lawyer Magnus Ehn, process office the Competition authority.
Just as Sweden was crying yesterday that their companies were being decimated in China, this is an example of how the media sector in Sweden operates in discrimination. Although this is not explicitly expressed legally, but insider dealings is very rife in Sweden and the laws are just smoke screams.
However, compared to other countries such as China, Sweden challenges these types of misgivings when they are discovered. In places such as China, they are ignored or laws passed that explicitly discriminates other non Chinese companies.
The Swedish authorities will never stop fighting for open and clean competition.
